TRADEMARK RULES & GUIDANCE

1. Copyright Notices

Attribution of Nitro's ownership of copyright material must be included on all external and internal printed and online material, where applicable, in the following format:

"Copyright © 2021 Nitro Software, Inc. All rights reserved. Nitro and the Nitro logo, Nitro Pro, Nitro Productivity Suite, Nitro Cloud, Nitro Admin, Nitro Analytics, Nitro VIP Access, Nitro PDF, Nitro Sign, Nitro Works, eSigning for All, Productivity Unleashed and QuickSign are trademarks and/or registered trademarks, of Nitro Software, Inc. or its affiliates in the United States and/or other countries."

2. Trademark Notices

For any and all uses of Nitro's trademarks by Nitro employees or by any third party with whom Nitro partners, the status of Nitro's trademarks must be properly designated by using the correct symbol (® or ™) in order to reflect Nitro's ownership of particular marks accurately.

This is important as while the TM symbol can be used on any mark being used as a trademark, it is an offence to falsely represent that a trademark is registered, if it is not, and using the ® symbol without registration would constitute such a false representation in relation to which penalties apply.

Specific usage guidelines are set out below:

Use the ® symbol only for registered trade marks.

Use the ™ symbol for any other trademarks (unregistered) or for pending applications.

In relation to letters, memos, press releases, white papers, advertising, slides, video, and other multimedia presentations:

Properly designate (with ® or ™) all of Nitro's trademarks; and

In the case of presentation graphics, the relevant trademark symbol should be designated on each page, slide.

In newsletters, magazines, and publications containing multiple articles:

Properly designate (with ® or ™) all of Nitro's trademarks on the first occurrence in the document, in headlines and on the first occurrence in every article in which they are used.

In brochures, annual/quarterly reports, books, technical documentation, and other bound documents:

Properly designate (with ® or ™) all of Nitro's trademarks on the first occurrence in the document, in headlines, and on the first occurrence in text.

In all charts or graphs, properly designate trademarks (with ® or ™).

On all packaging, the relevant trade mark symbol (with ® or ™) must be used in every reference.

Nitro's trademarks must not be varied in any way when used, and must be displayed exactly as they are registered.

3. Exception - References to the company name

When the word Nitro is used to refer to our company, Nitro Software, Inc., rather than as a brand of product or services, then the rules for proper usage change slightly. Unlike trademarks, company names are proper nouns; they can be used in the possessive form and do not need to be followed by a generic term. Neither the ™ nor ® symbol need to accompany references to Nitro as a company.

For Example:

Correct: Nitro is now offering unlimited eSignatures for all customers.

Incorrect: Nitro® is now offering unlimited eSignatures for all customers.

4. Ownership Assertion

You may not use the Nitro brand in any way that asserts another company's ownership of it, whether by incorporating a Nitro brand into their own product or service names, trademarks, logos, company names, or domain names or seeking a trademark or domain name registration for any term that includes a Nitro brand.

Consent must be obtained from us to use any of Nitro's trademarks for these purposes, or any other purpose.

5. Nitro Logo Use

You may not make unlicensed use of Nitro trademarks, including its logos. Any third party use of Nitro trademarks requires a specific license or written permission from Nitro for the proposed purpose.

6. No Trademark Bidding

Unless expressly permitted in an agreement between a third party and Nitro, no third party may bid on a Nitro trademark (or any variant or extension thereof) as a keyword on any search engine, nor are they permitted to use any of Nitro's trademarks in any advertising campaign including in Google AdWords campaigns, without express permission from us, and you will use your best endeavors to prevent this from occurring.

7. No Tarnishment

You may not use a Nitro trademark in a disparaging or degrading manner, or in any manner which interferes with the reputation and goodwill of Nitro.

9. Partner Logos & Word Marks

Apple, Mac, macOS, iPad, iPhone, iPadOS, iOSand Safari are trademarks, or registered trademarks of Apple Inc. in the U.S. and other countries.

Microsoft, Windows, Internet Explorer, OneDrive, SharePoint, PowerAutomate and Microsoft Word are trademarks, or registered trademarks of Microsoft Corporation in the United States and other countries.

Google, Chrome, Chrome OS, Google Drive, and Google Docs are trademarks, or registered trademarks of Google LLC in the United States and/or other countries.

Adobe, Reader, and Flash are registered trademarks or registered trademarks of Adobe Systems Incorporated in the United States and/or other countries.

Salesforce, AppExchange, and others are trademarks of salesforce.com, inc., and are used here with permission.

Box is a registered trademark of Box Inc in the United States and/or other countries.
